1. Broker status — not a carrier, not a medical provider

Limitless Sky and Sea LLC acts solely as an independent air charter and medical transport broker. We do not own or operate aircraft and we do not employ flight crews. All flights are operated by third-party direct air carriers certificated under FAR Part 135, EASA Part-CAT, or an equivalent national authority, and selected on a per-flight basis. We are not a medical provider; clinical care is delivered by accredited medical partners who remain solely responsible for medical decisions, treatment and outcomes. This disclosure is made in accordance with 14 CFR § 295.

2. Quotes and bookings

Quotes are estimates based on the information you provide and remain valid for the period stated on the quote (typically 24–72 hours), subject to aircraft, crew, slot, permit, fuel and medical availability. A booking is only confirmed once we issue a written confirmation and the required deposit or full payment has been received. Medical clearance, fitness-to-fly assessment and receiving-facility acceptance must be obtained before departure.

3. Pricing, payment, taxes

Prices are quoted in USD or EUR as agreed and exclude any taxes, duties, overflight or landing fees imposed after quotation, and third-party costs (hospital admission fees, ground ambulance surcharges, customs, immigration). Payment by wire transfer or card as specified on the invoice. Late payment may incur interest at the lower of 1.5% per month or the maximum allowed by law.

4. Changes, delays and cancellations

Schedules depend on weather, ATC, airport curfews, slot and permit clearances, patient condition and operator availability. We will use commercially reasonable efforts to mitigate delays but are not liable for circumstances beyond our reasonable control. Cancellation fees are set out in the booking confirmation and reflect the operator's cancellation schedule plus any unrecoverable costs (positioning, crew, slots, handling).

5. Client responsibilities

• Provide accurate, complete and timely patient information, medical records and identity documents.
• Ensure all passengers hold valid passports, visas and any required entry permits.
• Authorise sharing of medical and identity data with the operator, medical team and authorities involved in the mission.
• Notify us immediately of any change in the patient's clinical condition before departure.

6. Insurance

Operators carry the passenger liability and aviation insurance required by their certification. Medical Evacuation maintains broker professional indemnity cover. Clients are strongly advised to confirm or obtain their own travel and medical evacuation insurance. Our role does not constitute insurance advice.

7. Limitation of liability

To the maximum extent permitted by law, Limitless Sky and Sea LLC's aggregate liability arising out of or in connection with any booking is limited to the brokerage fees actually received by us for that booking. We are not liable for indirect, incidental, consequential or punitive damages, loss of profits, business or opportunity. Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by our negligence where such limitation is prohibited by law.

8. No medical advice

Content on this website is for general information only and is not medical advice. Always consult qualified medical professionals regarding fitness-to-fly and treatment decisions. No flight is operated and no medical service is delivered solely on the basis of website content.

9. Intellectual property

All content on this website — text, images, logos, design — is owned by or licensed to Limitless Sky and Sea LLC and protected by applicable laws. You may not copy, reproduce or republish material without our prior written permission, except for personal, non-commercial reference.

10. Sanctions and compliance

We do not arrange flights in violation of applicable export control, sanctions or anti-money-laundering laws. We may refuse or cancel any booking that, in our reasonable judgment, would breach such laws or our internal compliance policies.

11. Governing law and disputes

These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-laws principles. The courts of Bernalillo County, New Mexico shall have exclusive jurisdiction, subject to any non-waivable consumer rights you may have in your country of residence.
